7 Reasons Why Sandeep Lamichhane Is Innocent

It all began with an allegation of rape against Lamichhane by a girl, who claimed to have met him through a friend and accompanied him to Nagarkot on August 17, 2023. Subsequently, an arrest warrant was issued against Lamichhane on September 8, leading to his suspension from the national team by the Cricket Association of Nepal (CAN) on the same day. Amidst Lamichhane’s consistent denial and staunch public support, including from his fans, the case proceeded to trial at the Kathmandu District Court. Despite his assertions of innocence, the Kathmandu court ultimately convicted Lamichhane of rape. The controversy extended beyond the courtroom, with the Scotland cricket team’s refusal to shake hands with Lamichhane during international matches, reflecting the seriousness of the accusations. In delivering the verdict, the judge emphasized Lamichhane exploited girl’s financial hardship and make an undue influence. Despite the legal conclusion, Lamichhane’s supporters continue to adamantly assert his innocence, highlighting a troubling lack of awareness regarding the gravity of such allegations. From protesting in Maitighar, stadium, social media and all over some people are not ready to accept the decision of court. Here are some points that people use to prove that Sandeep cannot be convicted of rape which of course are all baseless.

1. He is a star cricketer.

Sandeep Lamichhane is a big cricket star in Nepal, often compared to famous players like Rashid Khan and Shane Warne. He’s incredibly talented, especially with his tricky bowling techniques like the googly. But even though he’s famous and talented, that doesn’t excuse him if he did something wrong. It’s important to remember that no matter who you are, the law treats everyone the same. So, if someone commits a serious crime like rape, they have to face the consequences, no matter how famous or talented they are.

2. Played in IPL

Sandeep Lamichhane stands out as one of the very few Nepali cricketers to compete on prestigious global platforms such as the IPL, CPL, BBL, and PSL, showcasing his remarkable skills. His presence in these leagues has not only represented Nepal internationally but also filled the nation with pride. However, it’s essential to recognize that participation in these leagues and achievements on the cricket field don’t negate the seriousness of the rape accusation against him. Regardless of his success as a cricketer, the allegations must be addressed impartially and independently.

3. Match winner for Nepal

Sandeep Lamichhane has undoubtedly been a crucial match-winner for Nepal, capable of single-handedly turning the tide of a game and snatching victory from the jaws of defeat. His absence from the team will undoubtedly be felt, given his talent and knack for delivering under pressure. However, the significance of his contributions on the field should not overshadow the gravity of the crime he commited. While his cricketing prowess is undeniable, it’s imperative that justice takes precedence. Nepal’s representation on the global stage should be reserved for individuals of integrity and character, not those accused of serious crimes like rape. Every player who represents the nation should embody the values of decency and respect, ensuring that the country’s reputation remains untarnished.

4. Gaushalla 26 went to hotel with him

It’s true that the girl, Gaushalla 26, went to the hotel with Sandeep Lamichhane. However, it’s essential to understand that simply going to a hotel together doesn’t imply consent. The court’s verdict emphasized that Lamichhane exploited his fame and influence to take advantage of the girl’s vulnerable financial circumstances. This highlights the crucial distinction between consensual actions and exploitation, underscoring the need to consider power dynamics and coercion in such situations.

5. Gaushalla 26 was not a minor

It’s significant to note that the girl involved in the case was found to be of legal age, which absolved Lamichhane of the charge of minor rape. However, this does not exonerate him from the broader allegation that he exploited her vulnerable financial situation to exert undue influence. Even though the absence of minor status alters the legal context, the ethical implications of leveraging someone’s financial struggles for personal gain remain troubling.

6. Highcourt has not declared him guilty

While some of Sandeep Lamichhane’s supporters argue that he shouldn’t be labeled a rapist because he hasn’t been proven guilty by the high court, it’s essential to recognize that he has already been convicted by the district court. It’s not accurate to disregard the district court’s verdict simply because Lamichhane has the right to appeal to the high court. The district court’s decision holds weight and reflects the evidence and legal arguments presented during the trial. Lamichhane’s decision to exercise his right to appeal does not erase the district court’s findings. The legal process will continue in the high court, but until then, the district court’s ruling stands as the current determination of guilt.

7. The girl did this for money

While Sandeep Lamichhane may have been willing to offer money, Gaushalla 26’s actions were driven by a pursuit of justice and the restoration of her dignity. It’s essential to understand that her decision to come forward was not motivated by monetary compensation but rather by a desire for accountability and validation of her experience. This underscores the importance of recognizing the profound impact of sexual violence on victims and the significance of seeking justice beyond material considerations.

At last, we want to say that there is no any reason to prove that Sandeep is innocent. He is guilty of rape until and unless upper court rules in his favor. Till then, everyone should believe in the rule of law and respect the decision of honourable court.
