Legal Battle Over Biryani Without Chicken Results In Compensation For Customer

A man in Bengaluru has won Rs 1,000 after he sued a restaurant when he found that the chicken biryani he ordered had not a single piece of chicken in it. A consumer court in the city recently ordered the restaurant to pay the amount as well as a refund of Rs 150 to the customer, Times of India reported.

The incident reportedly took place in April this year when Krishnappa, a resident of Nagarbhavi in west Bengaluru, ran out of cooking gas at his home. He and his wife went to a local eatery near their house in ITI Layout and placed an order for chicken biryani as a takeaway. When they got home with the parcel and opened it, they found out to their disappointment that the flavoured rice did not have a single piece of meat in it, according to the Times of India report.

Krishnappa then called up the eatery and flagged the issue upon which the eatery assured him that they would home-deliver another batch of biryani with chicken pieces in it. When the food did not arrive for two hours, the man and his wife resorted to eating the meatless biryani they had brought home. An angry Krishnappa tried contacting the eatery once again but had no luck.

Later that month, he issued them a legal notice to which he got no response from the restaurant. He then complained to the Bengaluru Urban area’s consumer disputes redressal commission about what happened with him and his wife. The customer demanded Rs 30,000 as compensation for the food that he paid Rs 150 for.

In October, the consumer court noted that the restaurant management had caused mental agony to the man and his wife. The court ruled that the restaurant must pay a compensation of Rs 1,000 and issue a refund to Krishnappa.
